Below is the Electronic Delivery Agreement. Please read the entire document. Submit
the information above and we will add you to the program and you will receive an
acknowledgement by email with further instructions regarding your username and password.
When your statement(s) are available for viewing, you will receive an email advising
you of that fact and providing a link to the site where you may sign in to view
and/or print your statement(s).

ELECTRONIC DELIVERY
AGREEMENT
City of Wichita Falls Utility Collections (hereafter referred to as “UC”) and its
licensor(s) (hereafter referred to as “the service”) are providing an on-line document
presentment service. Please read this agreement carefully before accessing or using
the Service. By accessing or using the service, you agree to be bound by the terms
and conditions below. If you do not accept the terms and conditions of this Agreement,
you may not access or use the Service. UC may modify this agreement from time to
time, and such modifications shall be effective immediately upon posting the modified
Agreement to the UC website. By continuing to access or use the Service following
such modifications, you agree to be bound by the modified agreement.
Document Presentment Service: By accessing the Service, (1) you authorize UC to
use this service to officially present your account statements; (2) you authorize
UC to use this service to present all required disclosures and official notices
that are normally sent by mail; (3) you agree that presentment constitutes fulfillment
of UC’s obligation to provide this information to you.
Notification of Document Availability: UC will cause an email to be sent to your
last known email address whenever a document is available to you. The email will
contain a link to the site where the document may be found. This site may be accessed
by use of login ID and password. It is your responsibility to notify UC of any change
in your email address. This notice must be in writing in a manner prescribed by
UC and signed by you.
THE FOREGOING SHALL CONSTITUTE UC’s ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY HEREUNDER.
Password and Security: The service will be accessible through a login ID and password
chosen by you. You agree not to give or make available your password to any unauthorized
individuals. If you believe your password has been lost or stolen or that someone
may attempt to use your password without your consent or has authorized payments
without your permission, you must notify UC at once. You understand the importance
of your role in preventing fraudulent use of your account and agree to properly
examine your statement as soon as you receive it, and notify us immediately of any
discrepancy. For security purposes, you are required to change your password upon
your initial log-in to the Service. You determine your password and the password
you select is not communicated to us. Your password should not be associated with
any commonly known personal identification, such as Social Security/Taxpayer ID
numbers, address, birth date, children’s names, etc., and should be memorized and
not written down. Notwithstanding our efforts to insure that the Internet system
is secure, you acknowledge that the Internet is inherently insecure and that all
data transfers, including electronic mail, occur openly on the internet and potentially
can be monitored and read by others.
Charges: As a member of UC, you will not be charged by UC for receiving a document
electronically.
Exclusions of Warranties: UC is providing the Service “As Is” without any warranty
of any kind, express or implied, including, without limitation, the implied warranties
of merchantability, fitness for a particular purpose, non-infringement and title.
UC does not warrant that the service is error-free, or that access to and use of
the Service will be uninterrupted or error-free.
Assignment: You may not assign this Agreement to any other party. UC may assign
this Agreement to any future, directly or indirectly, affiliated company. UC may
also assign or delegate certain of its rights and responsibilities under this agreement
to independent contractors or other third parties.
General: This Agreement is governed and shall be construed in accordance with the
laws of the State of Texas. This Agreement constitutes the entire Agreement and
supersedes any prior agreements or understandings, oral or written, between UC and
you concerning the Service. Failure or delay in enforcing any right or provisions
of this Agreement shall not be deemed a waiver of such provision or right with respect
to subsequent breach or a continuance of an existing breach. If any provision of
his Agreement shall be held to be unenforceable, that provision will be enforced
to the maximum extent possible, and the remaining provisions of this Agreement will
remain in full force and effect.
